Are Illegal Late Term Abortions Being Performed in New Zealand?.

Dear Ms Cole,

The Perinatal and Maternal Mortality Review Committee in its annual report for 2017 provided statistics on perinatal mortality resulting from abortion in 2016.

There were:- 20 – 22 weeks  87. 23 – 24 weeks 32. 25 -27 weeks 13. 28 – 31 weeks 14. 31 weeks – 2.

It is noted that your Committee’s annual report to Parliament does not provide this detailed information and only provides a total for over 20 weeks. What reason does the Committee have for withholding this important information from Parliament?

I wish to request that your committee consider including in its annual report the detailed abortion statistics provided by the Perinatal and Maternal Review Committee. 

In table 4.3 of the report the reasons provided by clinicians for post 20 week abortions are listed for the 148 abortions. The major reasons were:-

Congenital abnormality 109.

Maternal conditions 32.

Antepartum haemorrhage 10.

It is noted that it is unlawful under the Crimes Act to authorise an abortion after 20 weeks gestation on the grounds of fetal abnormality. The fact that congenital abnormality is given in the case of 109 abortions suggests that these abortions were unlawful and that these unborn children were deprived of their life unlawfully.

I would be grateful if you would advise me what action your Committee will now take to investigate the lawfulness of the 148 post 20 week abortions performed in 2016 and to ensure that all future post 20 week abortions conform to the requirements of the Crimes Act.

Right to Life Asks Government the Hard Questions About Decriminalising Abortion.

Official Information Act Request.

Thank you for your letter of 16 March 2018. I wish to request under the Official Information Act the following information:-

You advised that you have requested, “The Law Commission to review current abortion laws that abortion should be treated as a health issue and that women who chose to have an abortion have the appropriate care and are treated with dignity and respect and not treated like criminals under the law.”

What evidence do you have that women considering an abortion are not treated with care, dignity and respect?

In view of the fact that section 183, Procuring an abortion by any means, [2] in the Crimes Act states, the woman or girl shall not be charged as a party to an offence against this section

What evidence do you have that women are treated like criminals?

It was recognised in the common law of England for more than 1,000 years that it was a crime to kill an unborn child because it was an innocent and defenceless human being. This prohibition was enshrined in the Crimes Act by the New Zealand Parliament in 1856. In sections 182 and 183.

What evidence do you have to support your government’s contention that it should no longer be a crime to kill an unborn child in an abortion?

The Law Commission in correspondence with Right to Life states that the terms of reference for the review of the abortion laws preclude the Commission from making any comment about the sanctity of life and the right to life of the unborn.

Was it your intention in presenting the terms of reference to the Law Commission on the abortion law review to direct the Commission to exclude in their review any reference to the right to life of the unborn child?

Our government is making Chemical Warfare against our own Children

The Prime Minister, Jacinda Ardern is commended for condemning chemical warfare. Recently she stated, “New Zealand condemns any use of chemical weapons, whether it is in Syria or on the streets of the UK. New Zealand believes all states must adhere to obligations under international law, including in respect of chemical weapons.”

It is inconsistent for the Prime Minister to denounce this crime against humanity while at the same time giving approval for the use of weapons of mass destruction in chemical warfare in New Zealand in a bloody civil war against our own children. The Abortion Supervisory Committee reported to Parliament in 2017 that 1,970, pre-born children were killed,  472 of whom were aged nine weeks or more, in their mother’s womb with the lethal chemical Mifegyne RU486 . This chemical was approved for the killing of children by the Minister of Health Annette King, in August 2001. In her media release on 30 August 2001, the Minister stated that,

“Mifegyne RU486 meets the international standards of safety and effectiveness required for medicines”.

Mifegyne RU 486, is not a medicine and pregnancy is not a disease. The lethal drug is not safe for the unborn child, nor is it safe for women. It is however, as the Minister claims, highly effective in killing the unborn. Since the introduction of this new chemical warfare against the unborn there have been nearly 18,000 unborn killed in New Zealand by this drug. This chemical war is also violence against women who are the second victims of this war.This is a crime against humanity.

Mifegyne acts by depriving the endometrium of a hormone which the human embryo requires to flourish, the embryo then dies of starvation. This highly effective chemical warfare is approved and funded as a core health service by the government and is used in a number of Public Hospitals. The Family Planning Association is an ardent supporter of chemical warfare with Mifegyne and in April 2013 commenced killing unborn children at its Tauranga clinic. The Association supports the decriminalisation of abortion, removing abortion from the Crimes Act and making it no longer a crime to kill an unborn child. The Association supports abortion being a reproductive choice for women for any reason with this lethal poison being available at all of its other 29 clinics.

Chemical warfare has been raging against our own children in the womb for more than fifty years. It is hypocritical for our government to condemn crimes against humanity in other countries while actively waging a war against our own children which is approved and funded by the government. This is a crime against humanity.

Right to Life asks when is the government going to stop this insane civil war against our own children? There will be no peace in New Zealand until this devastating war against our nation’s children in the womb is stopped.

Dr Duncan Webb MP, “Abortion does not constitute the violent killing of a defenceless child

Right to Life is disappointed that Dr Duncan Webb MP, Labour, in response to our Society’s letter of 9 August 2018, stated, “abortion does not constitute the violent killing of a defenceless child.” Dr Webb is a Professor of Law and it is with respect that we challenge this statement which raises many important questions.

The Crimes Act, section 182 Killing an unborn child, is emphatic in declaring that it is an unborn child that is killed and that it is a serious crime to kill an unborn child. 

The killing is indeed violent, a suction curettage abortion entails the dismemberment of the child by tearing the legs, arms and head off the child. It is the responsibility of the assisting nurse to reassemble the body parts to ensure that all limbs are recovered. 

It is indisputable that the child is defenceless it is unquestionably the weakest and most defenceless member of the human family. Why is Dr Webb in denial that abortion violently kills a defenceless unborn child?  [Read more…]

Overwhelming Majority of Submissions to Law Commission Oppose Decriminalisation of the Killing of Unborn

The Law Commission under the Official Information Act has released to Right to Life information on the written submissions received by the Law Commission from the community on the review of the abortion laws in New Zealand.

 The President of the Law Commission, Sir Douglas White has advised Right to Life on 14 August, that a total of 3,419 submissions have been received. The issue was set out by the Minister of Justice, Andrew Little in a letter to Sir Douglas dated 27 February; The government is considering how best to ensure New Zealand’s abortion laws are consistent with treating abortion as a health issue. It was the wish of the Prime Minister that abortion be taken out of the Crimes Act and treated as “a reproductive choice for women.” The killing of the unborn child was no longer going to be treated as a crime.

 A total of 73.5 per cent of submissions which addressed the issue, opposed the decriminalisation of abortion and only 26.5 per cent of submissions which addressed the issue supported the decriminalisation of abortion.

Of the 2,278 submissions which addressed the issue, the Commission identified 603 that supported treating abortion as a health issue and/or removing abortion from the Crimes Act and 1,675 as opposing changes to the current criminal offences and/or opposing decriminalisation. The remaining 1,141 submissions did not address the issue. We are advised by the Law Commission that many of these 1,141 submissions supported protection for the unborn child and their mothers, this group will be summarised and the summary will be provided to the Minister of Justice in October. In the meantime there will be no information provided to the public on this summary until the Minister is advised.

Right to Life believes that this information provides conclusive evidence that the majority of the community are adamantly opposed to treating the killing of defenceless unborn children as a health issue and support protection for the lives of our unborn provided by the Crimes Act in sections 182, Killing of Unborn Child and 183 Procuring abortion by any means.

Right to Life earnestly requests that the government recognise and acknowledge that the government has no mandate from the people of New Zealand to remove the unborn who are classified as “unwanted “ from the protection of the Crimes Act where they have been protected since 1856, in order that it might facilitate the killing of these children as a health issue.

Right to Life also encourages the government to recognise that the first and only duty of government is to protect the lives of every member of the community from conception to natural death and not to preside over their destruction. It should recognise that the unborn child is the weakest and most defenceless member of the human family and deserves our respect and effective legal protection. Pregnancy is not a disease and abortion is not health care. It should also recognise that the sexualisation of our youth with Family Planning style comprehensive sex education programmes and the seductive “safe sex” message is promoting promiscuity, pregnancies outside of marriage and abortions.

Euthanasia – Conscience Issue

We are aware that it is the intention of Maryan Street to return her bill, “End of Life Choice” bill to the ballot following the general election. This contentious bill may or may not be drawn during the term of the next Parliament.

Euthanasia is about doctors killing or assisting in the suicide of their patients. Both are serious crimes, found in the Crimes Act 1961, Part V III, Crimes Against the Person. The former under section 160 Culpable Homicide.  The latter under section 179.

(1) Homicide may be either culpable or not culpable.

(2) Homicide is culpable when it consists in the killing of any person—

(a) by an unlawful act; or

(b) by an omission without lawful excuse to perform or observe any legal duty; or

(c) by both combined; or

(d)by causing that person by threats or fear of violence, or by deception, to do an act which causes his or her death; or

(e)by wilfully frightening a child under the age of 16 years or a sick person.

(3)Except as provided in section 168, culpable homicide is either murder or manslaughter.

(4)Homicide that is not culpable is not an offence.

Section 179: Every one is liable to imprisonment for a term not exceeding 14 years who;

(a) Incites, counsels, or procures any person to commit suicide, if that person commits or attempts to commit suicide in consequence thereof; or
(b) Aids or abets any person in the commission of suicide .

These laws are there to protect the vulnerable in society. Euthanasia is a conscience issue. Should the bill of Maryan Street be introduced to the Parliament, I would be grateful if you would assist us by advising where your conscience stands, by responding to the following questions.

  • Do you support in principle the Crimes Act being amended to allow for euthanasia?
  • Would you personally vote for the “End of Life Choices” bill to be passed into law?

Recently Pope Francis spoke in horror of the so many “legal human sacrifices” taking place around the world. He was referring to the increasing tide of abortion. “Thou shalt not kill” is one of the Ten Commandments yet Tasmania last week passed a law taking abortion out of the crimes act and treating it as a health issue, effectively abortion on demand up to the moment of birth. The Minister of Health Michelle O’Byrne boasted that the new law brings Tasmania into the 21st century and helped remove the stigma of abortion. Freedom of conscience is not allowed, a doctor faces being struck off if he or she refuses to provide the name and contact details of the abortionist. A counsellor who refuses to be complicit in the death of the preborn child faces conviction and a fine of A$4,525. Freedom of assembly is not allowed. Nobody is allowed within 150 meters of an abortion clinic to pray, offer assistance or counselling. Such a breach of the new law earns conviction and a fine of up to A$9,750, or imprisonment for up to 12 months.

Right to Life Comment: Now Tasmania has legalized murder of the unborn up to birth. What is more,  dissent itself, now seems to be being criminalised. Think carefully about Pope Francis’ description of the tide of killing now sweeping the world, ‘legal human sacrifices’.

Dr Simon Snook–Right to Life Believes this Doctor is a Disgrace to the New Zealand Medical Profession

Dr Snook (pictured), Certifying Consultant – Abortion is about Choice

I wish to bring to your attention statements made by Dr Simon Snook in the October issue of the magazine North & South. Dr Simon Snook is a certifying consultant and an abortionist.

He is quoted as saying:

‘I have never met anyone who is flippant about doing a termination. But I don’t view an embryo or fetus as having the same rights as the person potentially having to raise it in the world. For me to have to say she is mentally unwell –or will be if the pregnancy continues-is a misnomer. This is about choice.”

The statement of Dr Snook is an affirmation of his belief that abortion is a matter for a woman to choose. The Crimes Act 1961 sets out in section 183, Procuring abortion by any means states that, everyone is liable to imprisonment for  a term not exceeding 14 years,  who with intent to procure the miscarriage of any woman or girl, whether she is pregnant or not, unlawfully administers to her any poison or drug or uses an instrument to procure a  miscarriage. The killing of a child by abortion is thus a very serious crime. Abortions are however excused for serious and rare grounds set out under section 187A.

Letter to Health and Disability Commissioner – Doctor Suspended – Unlawful Prescriptions

I would be grateful if you were able to assist me with information on an important matter. On  30th April in the Christchurch Press there was an article reporting on a recent decision of the Health Practitioners Disciplinary Tribunal. A Doctor had been found guilty of unlawfully prescribing the abortion drug Misoprostol to three of her patients. The doctor had been censured and suspended from practising for a period of six months. The name of the doctor was temporarily suppressed. I have been advised that the doctor is seeking permanent name suppression and is appealing against the release of her name in the High Court.

The doctor who unlawfully prescribed this dangerous drug has broken the law. The Crimes Act 1961, under section ‘eight’, Crimes Against the Person, has section 183, Procuring Abortion by any means. It reads, “Everyone is liable to imprisonment for a term not exceeding 14 years who, with intent to procure the miscarriage of any woman or girl, whether she is pregnant or not,-[a] Unlawfully administers to or causes to be taken by her any poison or any drug … “

These are serious crimes against the right to life of three defenceless unborn children.

Right to Life believes that these matters should be brought to the attention of the Police in order that they may be investigated with a view to having charges laid in the High Court. Our Society has been advised by the office of the Tribunal that this is not the responsibility of the Tribunal.

I would be grateful if you would advise me if it is the responsibility of your office to report these matters to the Police and if so, if it is your intention to take this action?
