Right to Life – Submission
Right to Life respectfully presents this submission for your consideration. Right to Life submits that the New Zealand Bill of Rights Act 1990, [BORA] section 8 be amended to recognise the right to life of unborn children in New Zealand.
In support of our submission is the case that Right to Life presented to the Court of Appeal in Wellington in our appeal against the judgment of the High Court in the judicial review of the performance of the Abortion Supervisory Committee. This document was prepared by Dr Ian Bassett Llb, of Auckland.
The United Nations Declaration of Human Rights states that our human rights are inalienable and universal. Our right to life therefore may not be taken from us nor may we relinquish it. Our right to life is universal which means that every human being has these rights.
The Universal Declaration recognises that we are endowed with human rights. That statement is recognition that our rights are given to us by our Creator, they are not given to us by the state or by the community.
It is contended that as human life begins at conception, our Creator has endowed every human being at the moment of conception with human rights, the foundation right being the right to life. At the moment of conception, every human being as the bearer of rights is entitled to the respect and legal protection for its right to life that is accorded to the human person.
The Crimes Act 1961, section 159 states that for the purposes of this Act, the unborn child only becomes a human being when it has completely proceeded in a living state from the body of its mother, this is a legal fiction, as birth is but one of the events in the life of every person.
The unborn child as the weakest and most defenceless member of the human family, is entitled to special protection. New Zealand is tragically witnessing a holocaust with the womb being today the most dangerous place for a New Zealander. We seek justice for our children and for their mothers and ask that you support our proposal for amendment of the NZBORA to give legal recognition for the right to life for our precious unborn.
